Without a Will, all of your assets will be transferred via the default intestacy laws of your state. The government will choose who receives your property, not you.

While a Will is useful to choose who receives your assets, your assets and estate still have to go through the lengthy and expensive process known as probate. This is a process that takes several months and thousands of dollars before your loved ones can receive access to your estate.
A properly funded Trust bypasses the probate process. Additionally, a Trust incorporates planning for your business, Retirement Accounts, and any other types of assets you may hold.

Community Property, which applies Texas, California and some other states, is the principle that nearly everything (with some exceptions) you acquire after marriage is shared between spouses. Husband and Wife both own 50% of all assets, even if only one spouse’s name is on it!
